The 16TH October, 1985


No. A1/85/298.- In exercise of the powers conferred by the provision the Ariticle 309 of the Constitution of India read with Government of India, Ministry of Home Affairs, Notification G.S.R. No. 3267, dated the 1st November, 1966 the Administrator, Union Territory, Chandigarh is pleased to make the following regulations further to amend the Punjab State Electricity Board, Service of Engineers (Electrical) Regulations, 1965, namely:-

  1. These regulations may be called the Punjab State Electricity Board Service of Engineers (Electrical) (Chandigarh Amendment) Regulation, 1985.
  1. They shall come into force from the date of their publication in the Chandigarh Administration Gazette.
  1. In the Punjab State Electricity Board, Service of Engineers (Electrical) Regulations, 1965 (hereinafter called the and regulations), regulation 2, for sub-regulation (g), the following shall be substituted, namely :-
     "(g) ‘Technical Subordinates Grade-I and Technical Subordinates Grade-II’ means categories listed as such in appendix      (C) to these regulations.
  1. In the said regulations in regulation 6, for sub-regulations (a), (b), (c), the following shall be substituted, namely :-
    1. In crease of posts of Assistant Engineers :-
           (i)     By appointment from Trainee Engineers as provided in regulation 9.
           (ii)     By promotion as provided in regulation 11.
           (iii)     By transfer of an officer already in the service of a Government or any other State Electricity Board or                an Undertaking of the Government.
    2. In case of posts of Assistant Executive Engineers:-
           (i)     By promotion from amongst Assistant Engineers.
           (ii)     By transfer of an officer already in the service of a Government of any other State Electricity Board                 or any Undertaking of Government.
    3. In case of posts of Executive Engineers and equivalent rank :-
           (i)     By promotion from amongst Assistant Executive Engineers and such Assistant Engineers                Subordinates under regulation 11…
           (ii)     By transfer of an officer already in service of a Government or any other state Electricity Board or any              undertaking of a Government.
  1. In the said regulations in regulation 7, after sub-regulation (b) the following shall be added, namely:-
     (c)     In the case of released Indian Armod Forces Personnel who joined service during the National Emergency on                1st November, 1962 or after and were released thereafter and in the case of ex-servicemen the upper age                limit may be relaxed to the extent of service rendered.
     (d)     In the case of :-
  1. Widows;
  2. Women who are legally separated from their husbands or have been divorced;
  3. Women whose husbands have been ordered by Civil or Criminal Courts to pay maintenance to them;
  4. Women who have because of their desertion been living separately from their husbands for more than two years;
  5. Women whose husbands have re-married; and
  6. Wives of the servicing military personnel and wives of the wives of these who are disabled while in Military service, the upper age limit shall be 35 years subject to the condition that they are otherwise eligible for the posts concerned.
  1. In the said regulations, for regulation 8, the following shall be substituted, namely :-

QUALIFICATIONS FOR DIRECT APPOINTMENT :-
  1. No person shall be appointed as Trainee Engineers unless he:-
  1. Has passed the examination making him eligible for obtaining a degree in Electrical, Mechanical or Telecommunication Engineering, as may be laid down for the post advertised from any University in India established or incorporated under a Central Act/Provincial Act or any other qualification recognized equivalent to the degree in Engineering awarded by Punjab University, Chandigarh. In the case of a degree from Foreign University, chandigarh. In the case of a degree from Foreign University, the same should be recognized by appropriate institution of Engineers of the country concerned, or
  2. Is a corporate Member of either of Institution of Mechanical Engineers or of the Institution of Electrical Engineers, London, or
  3. Has passed in full (in all papers) and not by exemption parts A and B of the Associate Membership. Examination of the Institute of Engineers (India), or
  4. Has passed the Graduate Examination of the Institution of electrical engineers (London).
    (b)     The Trainee engineers shall be appointed for a period of one year and shall be allowed the regular scale of pay Assistant Engineers. However, the service as Trainee Engineer shall not be reckoned towards minimum service prescribed for promotion. The majority in service shall be reckoned after regular appointment as Assistant Engineer in accordance with the Regulations on the subject.
    (c)      The Trainee Engineers shall be appointed as Assistant Engineers on satisfactory completion of one year training which may be extended upto maximum period of 3 years. During the period of their training, they shall also be required to pass the ‘Safety Code Test’ prescribed’ by Engineering Department of the Chandigarh Administration. The test will be conducted by the Superintending Engineers concerned. The appointing authority may terminate the service of a Trainee Engineer without giving any notice, if:-

    (i)      he fails to qualify the ‘Safety Code Test’ within the training period.

    (ii)     his work and conduct during the period of one year or during the extended period of training is not satisfactory.

    (d)     Candidates on appointment as Trainee Engineer will be required to give in writing an undertaking on a duty stamped paper that they will serve the Engineering Department of the Chandigarh Administration for a minimum period of 2 years after completion of the training, failing which they will be required to refund to the Engineering Department, the entire cost (pay and allowances etc.) incurred by the Engineering Department subject to a minimum of 3 months pay and allowances together with interest thereon from the date of demand.

    (i)     Where a Trainee Engineer is called for Military service under regulation 11-A of these regulation within the period of training (original or extended) or thereafter within a period of 2 years, the period of Military service shall count towards the training period and the condition of 2 years service in the Engineering Department, will not apply in this case ;

    (ii)     Has obtained from the Medical Authority a certificate of mental and physical fitness as prescribed in Appendix (c) and is considered by the medical Authority to fit in all respects for actual outdoor duty.

    Note:-      Fee to the Medical Authority shall be payable by the candidate. In the case of candidate belonging to Scheduled Caste, the fee so payable shall be reimbursed to the candidate.

    (iii)     the appointing authority is satisfied that his character and antecedents ars such as to qualify him for appointment as Training Engineers; and

    (iv)     has not more than one wife living or in the case no a workmen, she is not married to a person already having a wife living. Provided that the appointing authority may if it is satisfied that there are special grounds for doing so, exempt any person from the operation of the condition ; and

    (v)     he is not a dismissed Government/boards/Government Undertaking’s employee or a person convicted of an offence involving a moral turpitude:

    (i)     Provided that the serving officials who possess ¾ years Diploma in Electrical/Mechanical Engineering and have minimum 12 years experience as Technical Subordinate in the Board with good record, shall be treated at par with Graduate Engineers for the purpose of direct appointment as Trainee Engineers/Electrical and Mechanical. Their seniority fixed in the order of merit determined at the time of selection shall not be disturbed.
    1. In the said regulations for regulation 9 of the following shall be substituted, namely :-
    1. (1)   Qualification for appointment by Promotion :- Upto 22% of the total No. of cadre posts of Assistant Engineers, excluding the posts under the maintenance Organisation and Carrier Communication Divisions may be filled by promotions out of junior Engineers Grade-I, under the Engineering Department, Chandigarh, possessing the following qualifications :-
    1. Junior Engineers having their record above average possessing minimum academic qualification of matriculation or its equivalent and with not less than 15 years service as Junior Engineer Grade-I and Technical Subordinate Grade-II out of which a minimum service of 5 years shall be as Junior Engineer Grade-I will be promoted to the post of Assistant Engineer.
    2. Junior Engineers holding 3 or 4 years diploma in Electrical or Mechanical Engineering of recognized Institute with 10 years minimum service as Junior engineer Grade-I and Technical Subordinate Grade-I out of which a minimum service of 5 years shall be as junior Engineer Grade-I, will be promoted to the posts of Assistant Engineers.

    Provided that the number of posts, held by Junior Engineers of category (a) shall not exceed 12% of the total number of cadre posts of Assistant Engineers.



         2(a)   In the maintenance organization and Carrier Communication Divisions, 25% of the posts of Assistant Engineers shall be reserved for Junior Engineers promoted from the posts of Test Inspectors, Telephone Supervisors and Telephone Construction Foremen on merit-cum-seniority basis as per clause (b) and (c) below.

         (b)   Junior Engineers having their record above average who may be promoted as per provisions contained in (a) above possessing minimum academic qualification of matriculation with not less than 10 years service as Junior Engineer, Test Inspector, Telephone Supervisor and Telephone Construction Foreman, as the case may be out ot which a minimum service of five years shall be Junior Engineer, will be eligible for appointment to the service, as Assistant Engineer, subject to the condition that their number, does not exceed 55% of the total number of cadre posts of Assistant Engineers reserved in (a) above.

         (c)   In addition to the 55% posts as per (b) above, 45% of the total number of cadre posts of Assistant Engineers reserved in (a) above shall further be reserved for Engineering Subordinates holding ¾ years Diploma in electrical Engineering of recognized institutes with 7 years minimum service as Junior Engineer, Test Inspector, Telephone Supervisor and Telephone Construction Foreman as the case may be, out of which a minimum service of 5 years shall be as Junior Engineer :

         Provide that in case vacancies exist for a particular category (Diploma or Non-Diploma) and eligible persons belonging to that category are not available, they may be filled up by eligible person(s) of the category.

         (3)   The Chief Draftsman/Circle Head Draftsman under the Engineering Department,. Chandigarh, having their record above average possessing Diploma in Electrical/Mechanical Engineering or Diploma/Certificate of a duration of two years either for combined course of Draftsmanship granted by the Punjab Government School of Engineering or in Electrical/Mechanical Draftsmanship of some recognized Institute or I.T.I. certificate holders, departmentally qualified and those having no technical qualifications but having already been promoted as Circle head Draftsman with not less than 13 years experience as Divisional Head Draftsman and on higher posts, out of which a minimum service of 5 years shall be as Circle head Draftsman, shall be eligible for appointment to the service as Assistant Engineers subject to the condition that their number does not exceed 3% of the total number of cadre posts of Assistant Engineers.

         (4)   After selection for promotion every eligible Chief Draftsman/Circle Head Draftsman would be required to serve as Junior Engineer Grade-II for six months in his own scale of pay and would be eligible for promotion after having completed satisfactorily this training period.

         (5)   Junior Engineers and Chief Draftsman/Circle Head Draftsman on appointment as Executive Engineers and Assistant engineers under Sub-Regulation 2 and 3 above respectively shall however, not eligible for further promotion to the post of Superintending Engineers and Assistant Executive Engineers and above respectively, unless they possess the qualification prescribed in Clause (a) of regulation 8 above.

         (6)   The holders of 4 years diploma of Victoria diamond Jublee Institute, Lahore, awarded prior to 15th August, 1947 or persons who completed their courses from that Institute prior to August, 1947 and were awarded Diplomas on the basis of special examinations held by the Director of Industries, Punjab in the years, 1948, 1949, 1951 and 1952 and who are employed and have put in at least 15 years service in the erstwhile Punjab P.W.D. Electricity Board branch/P.S.E.B. shall be treated at par with Graduates in Engineering of Indian Universities for purposes of confirmation and promotion to posts and services under the Engineering Department, Chandigarh with effect from the dates they have gained 15 years practical experience in service.

         (7)   9% of the cadre posts of Assistant Engineers (Electrical/Mechanical) shall be reserved for Departmental employees (Technical Subordinates and Drawing Staff) who while in service of the Engineering Department, Chandigarh having qualified Section (A) and (B) of AMIE Examination and have completed three years service.

         Note:- the persons promoted against the above reservation will remain on probation for a period of one year in the promoted rank.

         8(a)   Such of the Assistant Engineers (Electrical and Mechanical) as have been promoted from the ranks shall be eligible for consideration for promotion as Assistant Executive Engineer (Electrical and Mechanical) after each of them has completed a minimum of four years service as Assistant Engineer and has either passed the Departmental Accounts Examination for Engineering Officers or has been exempted from passing the same, in the following manner:-
    1. In the case of Diploma holders Assistant Engineers (Electrical and Mechanical) to the extent of 10 per cent of the total permanent and temporary posts in each category.
    2. In the case of non-diploma holder Assistant Engineers (Electrical and Mechanical) but possessing minimum qualification of matriculation along with a certificate in the trade of Electrical/Mechanical including Lineman/Wireman/Draftsmanship (Electrical and Mechanical) from the recognized Industrial Training Institute to the extent of 10 percent of the total permanent and temporary posts in each category. On promotion these officers shall be posted on Operation and Construction side.


         (b)   Out of the officers who have been promoted as Assistant Executive Engineers only diploma holder Assistant Executive Engineers (Electrical and Mechanical) shall be eligible for consideration for further promotion as Executive Engineer (Electrical) to the extent of 10 percent of the total posts in that category, on completion of total 20 years services out of which 12 years service must have been rendered as Assistant Engineer and Assistant Executive Engineer, provided further that out of the above 12 years service a minimum of 4 years service be as Assistant Engineer and a further minimum of 6 years as Assistant Executive Engineer. On promotion as Executive Engineer, they shall be posted on operation and construction side.

         (c)   The existing percentages prescribed for direct recruitment of Assistant Engineers (Electrical and Mechanical) shall remain un-disturbed. At no stage, the representation of promottee Assistant Engineers Cloass, other than E.M.I.E. qualified hands, shall exceed 28 percent of the total posts of Assistant Engineers (Electrical and Mechanical).

    Similarly at no stage the representation of promottee Assistant Executive engineers shall be more than 20% of the total posts of Assistant Executive Engineers (Electrical). In the same manner, the representation of promottee Executive Engineers (Electrical) shall not exceed 10 percent of the total posts of Executive Engineers (Electrical).

         (d)   Such of the A.M.I.E. qualified hands, Electrical and Mechanical, as have been promoted as Assistant Engineers (Electrical and Mechanical) on the basis of existing reservations in the respective regulations shall not reap any further benefit on account of these decisions.

         (e)   The decisions shall be enforced with immediate effect with the rider that none of the existing Assistant Executive Engineers (Electrical and Mechanical) shall be reverted merely in order to make room for promotee officers. On the other hand, their exact share on the basis of total posts both permanent and temporary shall be worked out and they shall have to wait until posts become available on the basis of the workload from time to time. As and when posts become available, it has been decided administratively to fill up such posts the claims of the promottee officers shall be considered on the basis of their service record in such a manner that 50% posts shall be filled up from amongst them and 50% posts from other Graduates till the share of the promottee officers to the extent of 20% of the total posts is fulfilled. Similar procedure shall be followed while making promotion to the posts of Executive Engineers in ea! ch category except in the case of Non-Diploma-holder Assistant Executive Engineers, who shall not be considered for further promotion as Executive Engineers.

         (f)   Non-Diploma-holder Assistant Executive Engineer shall not be eligible for promotion as Executive Engineers and Diploma Holder Executive Engineer shall not be eligible for promotion as Superintending Engineers.

         (g)   In case a junior officer has completed four years as Assistant Engineer but his senior has not yet done it, the former shall have to wait until the latter completes it.

         (h)   Inter se seniority amongst Graduate Engineers and promottee officers in the rank of Assistant Executive Engineers, shall be determined on the basis of their seniority as Assistant Engineers in each category provided the latter (officers promoted from ranks) shall appear below all the Assistant Executive Engineers already promoted up to and on 11th October, 1973).

         (i)   9% of the posts of Assistant Engineers Electrical/Mechanical may be reserved for promotion from amongst the graduates in Electrical/Mechanical Engineers/A.M.I.E. qualified hands who possess this qualification at the time of appointment as Technical Subordinates in the Engineering Department, Chandigarh, after completing 3 years service in that capacity. Engineers, Superintending Engineers and Chief Engineers shall be determined their continuous appointments in that class :

    1. In the said regulations for regulation 10, the following shall be substituted namely:-


    PROCEDURE FOR RECRUITMENT BY DIRECT APPOINTMENT

    1. (1) For filling posts by direct appointment, applications will be invited through advertisement.


         (2)   All direct appointments to the service shall be made by the appointing authority after conducting written test followed by interview of the candidates by the Selection Committee constituted by the Engineering Department, Chandigarh, for the purpose.

    1. In the said regulations, for regulation 11, the following shall be substituted namely :-

    No officer shall have any claim to promotion as a matter of right on the basis of mere seniority.

    Provided that number of the service shall not be eligible for promotion to the post of Assistant Executive Engineer and above until he has passé the Departmental Accounts Examination and Departmental Professional Examination and Safety Code Examination prescribed for Engineering Officers unless exempted by the Engineering Department, Chandigarh, from passing the said examination for reasons to be recorded in writing. The appointing authority, may however, promote an officer, who has not passed the Safety Code Examination as Assistant Executive Engineer on provisional basis subject to the condition that he shall pass the examination within a period of three months of his promotion or such extended period as may be allowed by the Appointing Authority.

    Provided further that the condition of passing the Departmental Accounts Examination, Departmental Professional Examination and Safety Code Examination before promotion as Assistant Executive Engineer shall not apply to officers who are called for Military Service under Regulation II-A of these regulations until their return from Military service when they will be allowed to avail of two chances occurring immediately following the date of their reversion or any other special chances as may be allowed by competent authority. On their failure to pass the said examinations during these chances, they would be liable to be recreated as Assistant Engineer.

    1. In the said regulations, after regulation 11, the following shall be added namely:-


    COMPULSORY LIABILITY SCHEME MILITARY SERVICE

    1. -A.     Any person appointed by direct recruitment to the posts of Assistant Engineer or Apprentice/Trainee Engineer on or, after the first day of May, 1996 shall, if so required be liable to serve in any denfence service or post connected with the Defence of India, for a period spend on training, if any.

    Provided that such person :-

    1. shall not be required to serve as aforesaid after the expiry of ten years from the date of appointment;
    2. shall not ordinarily be required to serve as aforesaid after attaining the age of 40 years;

    1. (A)   In the said regulation in, in regulation 12, after sub regulation (d), the following shall be added, namely:-


       “    (a) Where an officer is called for Military Service under Regulation 11-A of these Regulations brfore expiry of his probationery period, the period of Military Services shall count towards the period of probation fixed under this regulation.

         (b)   In the said regulation, in regulation 12, for Sub Regulation (2), the following shall be substituted, namely:-

         (2)   On the completion of the period of probation (original or extended) as the case may be, the Appointing Authority may confirm such member in his Appointment or if his work and/or conduct has, in the opinion of the Appointment Authority not been satisfactory or he has not been able to pass, the Departmental Accounts Examination, Departmental Professional Examination and Safety Code Examination, Appointing Authority may dispense with his service if recruited direct, or revert him to his former post or Department as the case may be, if recruited otherwise provided that the Engineering Department, Chandigarh may exempt any member from passing whole or any part of the said examination for reasons to be recorded in writing.

         12.   In the said regulation, in regulation 13 for the words assistant Engineers Clss-II and Assistant Engineer Class-I            (Junior), the words `Assistant Engineer’ and `Assistant Executive Engineer’ shall be substituted.

         13   In the said regulations, regulation 14, for the words. The Board Assistant Engineer Class-I (Junior); the words           `Appointing Authority’ and Assistant Executive Engineer’ respectively shall be substituted;

    And


                The words `Class-II’ appearing in regulation 14 shall be deleted.

         14   In the said regulations, for regulation 15, the following shall be substituted, namely:-

    SENIORITY

         15   The seniority interse of members of the service in a particular class of post viz. Assistant Engineer. Assistant Executive Engineers, Executive Engineers, Superintending Engineers and Chief Engineers shall be determined …………………………………..

    Provided, firstly, that in the case of members appointed by directed appointment, the order or merit determined at the time of selection shall be not disturbed so as the seniority in the class of post to which direct appointment was made is concerned and persons appointed as a result of an earlier selection shall be senior to those appointed as a result of subsequent selection:

    Provided secondly that in the case of two or more members appointed on the same date, seniority shall be determined as follows:-

    1. In the order of the salaries allowed to them on such date, the higher paid being placed above, the lower paid or if both the date of appointment and the salary be the same, in the order of age, the elder being placed above the younger, and
    2. In the case of members of the service appointed as Assistant Engineers and above by promotion according to their relative seniority in the lower class from which they were promoted unless a member of a lower class is promoted earlier than another member of that class, who is senior to him and the latter has been passed over on the score fo unsuitability or ineligibility for promotion in which case the member of the lower class first promoted shall take rank in the higher class above. Such other member of the lower class if and when the latter is promoted as Assistant Engineer and /or above:

    Provided, thirdly that a member of the service who is appointed as Assistant Engineer by direct appointment shall be senior to all members of the service appointed as assistant Engineer by promotion from the subordinate class who may be appointed in the service after appointment of any member by direct appointment in the same batch of selection:

    Provided, fourthly, that the seniority of a member of the service appointed by transfer shall be determined by the Appointing Authority on the merits of each case:

    Provided, fifthly, that if a member of the service is promoted temporarily t a post earlier than his senior for reason other than the inefficiency of the senior person or his ineligibility for promotion they will rank inferse according to their relative seniority in the class from which they were promoted:

    Provided, sixthly, that in the case two or more Technical Subordinates from different categories became eligible for promotion to the rank of Assistant Engineer on fulfilling the requisite conditions against 9% reservation provided in Sub-Regulation (7) of Regulation-9 above, their seniority for appointment as Assistant Engineer shall be determined as under:-

    1. Those working in higher ranks shall be senior to those working in lower ranks at the time of consideration for promotion.
    2. Those working in the same cadre, in order of their respective seniority in the rank from which they are to be promoted at the time of consideration for promotion irrespective of date of passing the A.M.I.E. examination
    3. In case of persons fixed in identical scales of pay but belonging to different classes, in the order of continuours length of service in the indentical scale and if the date of appointment is the same, in the order of their age, the older being placed above the younger.


         Note;-1   This regulation shall not apply to members appointed on purely provisional basis pending their passing the                      qualifying tests/examinations.

                  2.   In the case, of members whose period of probation is extended, the date of appointment for the purpose of the regulation shall be deemed to have been deferred to the extent, the period of probation is extended.

    Except those employees, who have already been confirmed, prior to the amendment of Regulation 15 caused here of, the seniority of the Members of the Service, ina cadre would be regulated and determined in accordance with this Regulation.

         15   In the said regulations, for Regulation 18, the following shall be substituted namely :-

    DEPARTMENTAL EXAMINATION


         18  (1) The member of the service shall be required to pass the following examinations, after successful completion of Training period, within the prescribed number of chances and/or period:-
    1. Departmental Accounts Examination prescribed for Engineer Officers of the Engineering Department.
    2. Departmental Professional Examination ; and
    3. Any other examination(s) as may be introduced by the Engineering Department, Chandigarh, from time to time.

    Note:-The examination against item (b) above shall be applicable to the new entrants anly, who were/not appointed to the service on or after 2nd May, 1967 either by direct recruitment or otherwise. This would also apply to the provisions of Departmental Professional Examination appearing in Regulations 11 and 12.

         (2)   They shall be required to pass the examination at (a) above with in three years from the date of their respective appointments/promotions. They shall also be allowed to re-appear in the examination even after the expiry of three years period of service subject to the conditions that fourth increment falling due on the completion of four years of service shall only be allowed retrespectively, if they pass the examination in six chances (whether taken/availed or not). The examination held within six months of the date of their appointment/promotion will, however, not be counted towards six chances, referred to herein. Those who fail to pass the examination within the prescribed chances, shall also be allowed the fourth and subsequent increments retrospectively on passing the said examination. However, they shall not be entitled to any arrears on account of released grade increment(s) for the period during which they fa! iled to clear the examination.

         (3)   They will not be considered for promotion unless they have passed the Departmental Accounts Examination. On passing the examination and on promotion to Class-I, they shall rank junior to all those who have been promoted earlier to them, provided that none would lose his original seniority if he clears the Departmental Accounts Examination within 6 chances as prescribed.

         (4)   The Engineering Subordinates with atleast five years service may be allowed to appear and qualify the Departmental Accounts examination prescribed for Engineer Officers at any time prior to their promotion to the rank of Assistant Engineer.

         (5)   (i) The Chief engineer may grant exemption to any member of the Service from passing the Departmental Accounts Examination at (a) above. The grant of exemption shall be considered in extremely hard cases on the following consideration :-

    1. The Officer making the request has attained the age of 50 years.
    2. The record of the Officer is consistently good and without blemish.
    3. The Officer has atleast made six attempts to clear the examination.


         ii   Once exemption has been granted to an Office, no disability, whatsoever, shall attach to him in order to consider him for further promotion.

         16   In the said regulations, regulation 20 shall be omitted.

         17   In the said regulations, for regulation 23, the following shall be substituted namely :-

    POWER TO RELAX

    Where the Administrator is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the regulations with respect to any class or categories of officers.

    No. P2/2007/47:- In exercise of the powers conferred by proviso to Article 309 of the Constitution of India read with Government of India, Ministry of Home Affairs notification bearing No. S.O. 3267, dated the 1st November, 1966 the Administrator, Union Territory, Chandigarh is pleased to make the following rules regulating the method of recruitment to Group ‘D’ posts of Electricity Operation Circle in the Engineering Department, Chandigarh Administration, namely :-

    1. Short title and commencement. – (i) These rules may be called the Engineering Department, (Group ‘D’) Posts of Electricity Operation Circle Chandigarh Cadre Recruitment Rules, 2006.
      (ii) They shall come into force on the date of their publication in the Official Gazzette.
    2. Application. – These Rules shall apply to thje posts specified in Column 1 of the Schedule annexed to these rules.
    3. Number of posts, classification and the scales of pay. – The number of the said posts, their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule or as amended by the competent authority from time to time.
    4. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the said posts, age limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the said Schedule, except that in the case of department candidates or the persons belonging to Scheduled Castes/Scheduled Tribes/O.B.C., the age limit may be relaxed in accordance with the instruction issued by the Government of India from time to time.
    5. Disqualifications.- (i) No person, who has more than one wife living or who having a spouse living, marries in any case in which marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to the said posts.
      Price : Rs. 3.00
      (ii)      No woman, whose marriage is void by reason of her husband having a wife living at the time of such marriage or who has married a person who has a wife living at the time of such marriage, shall be eligible for appointment to the said posts.
      (iii)       The Administrator, Union Territory, Chandigarh may, if he satisfied that there are special grounds for so ordering, exempt any person from the operation of this rule.
    6. Savings. – (i) Nothing in these rules shall affect reservations, other concessions required to be provided for the Scheduled Castes and Scheduled Tribes/O.B.C. and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
      (ii)      These rules shall have precedence over the existing rules for which the provisions have made in these rules.
    7. Power to Relex.- Where the Administrator, Union Territory, Chandigarh is of the opinion that it is necessary or expedient so to do, he may by order, for reasons to be recorded in writing relax any of provisions of these rules in respect of any class or category of persons.
