Citizen's Charter
CHANDIGARH HOUSING BOARD
The Citizens' Charter is not a legal document. Its purpose is information
dissemination. Thorough case has been taken while preparing it, yet in case any
repugnancy inter-se the Citizens' Charter and the Rules/Regulations or policy
documents of CHB, the later shall prevail.
PREFACE
The Citizens’ Charter of Chandigarh Housing Board is a statement of
objectives and guiding principles for a transparent, responsive and public
friendly organization, our endeavor is :
- To construct well designed, good quality and reasonably priced houses.
- To float housing schemes for current requirements of the general public
for best utilization of the land available.
- To establish convenient and transparent procedures for allotment,
possession, payments and transfer of property.
- To uphold building by-laws for the safety and comfort of all residents of
CHB dwelling units.
- To ensure prompt and courteous redressal of grievances.
This booklet spells out procedures for various services and also indicates
the time frame within which allottees should expect the work to be done.
The last page of the booklet is for suggestions which can be filled up and
put into the Suggestion Box at the Reception Counter or mailed to Secretary,
CHB. It is assured that they shall be given due attention.
We welcome suggestions for further improvement in the functioning of the
Board to make it more useful and public friendly.

A. ABOUT THE BOARD
Chandigarh Housing Board (CHB) was established in March, 1976
by extending the Haryana Housing Board Axct,1971 with the primary object to
provide good quality and economical houses for shelterless persons residing in
the U.T. of Chandigarh. The Board has been providing houses on affordable price
and of the best material. To make optimum utilization of land, four storey flats
have been constructed and so far more than 44,000 dwelling units have been
constructed in Chandigarh. The Board also undertakes other schemes which are
entrusted to it by the Administrator U.T. Chandigarh. The Board has undertaken
development of parts, recarpeting of roads in housing colonies constructed by it
and has also constructed and allotted commercial booths in various housing
colonies developed by CHB in the U.T.
The Board is
constituted under Section 3 of the Haryana Housing Board Act, 1971 as extended
to U.T., Chandigarh for a period of three years. There are 6 official and 3
non-official members of the Board.

B. EXISTING ALLOTTEES
I. ALLOTMENT AND PHYSICAL POSSESSION:
After the specific
dwelling unit is allotted through draw of lots on their completion, allotment
letter is issued for the acceptance of conditions of allotment laid therein and
to deposit the requisite payments and documents within the specified time. On
completion of these requirements, the allottees are issued possession slip and a
possession booklet for taking physical possession at site.
Physical possession:
After obtaining
possession slip and booklet, allottee is required to approach the possession
office at site.
While taking over the
physical possession of the dwelling unit the allottee must check the items
handed over to him/her as per inventory given in the possession booklet.
Any
defect/incompletion noticed by the allottee, in the flat, while taking over the
physical possession, is mentioned in the register maintained in the Possession
Office.
Complaints, other
than normal maintenance, shall be attended by CHB up to a period of 30 days
after taking over the possession of the flat.
CHB shall not be
responsible for any fault, which may occur due to any additions/alterations
carried out by the allottee in the original work done by CHB.
The
maintenance/proper usage of the common portions and services shall be the
responsibility of the Registered Agency or allottees/hirers, if any Registered
Agency for the purpose of chapter IV of the CHB (Allotment, Management and Sale
of Tenements) Regulations, 1979, is formed by the group of allottees/hirers.
Every allottee shall be responsible for maintenance of
individual services and rectification of defect causing damage to the adjoining
unit(s) to the satisfaction of the allottee whose property has been damaged. In
case the allottee fails to get such defects rectified, CHB may rectify the same
on receipt of a complaint by the concerned E.E. at the risk and cost of
defaulting allottee and the amount spent is recoverable as arrears of land
revenue
II. PAYMENTS
All payments in respect of the dwelling units are to be made in CHB account
with the Bank as specified in the allotment letter by the 10th of every month.
Delay in making the payments attracts penal interest and penalty/liquidated
damages at the rate as given in the Allotment letter. For delay beyond three
months, allotment is liable to be cancelled. The allottees should get their
accounts reconciled with the Recovery Section annually in the month of May/June
by submitting an application to the CAO giving details of payments
III. DOCUMENTS ISSUED BY THE BOARD
NO OBJECTION CERTIFICATE FOR OBTAINING LOAN BY MORTGAGING THE PROPERTY
Applications for raising loan from Govt. /scheduled bank/LIC/Corporate
Body is to be addressed to the concerned Accounts Officer. The following
documents are to be enclosed along with the application on the plain paper
specifying the reasons of taking loan: -
Consent letter original from the Bank/Organization from where the loan is to
be taken. Undertaking on prescribed Proforma available at the Reception Counter.
(Only in case if the Allotment letter is not issued.)
IV. For obtaining information about interest component in the installments
Allottee can apply to the concerned Accounts Officer alongwith following
documents. Original receipt of deposit of Processing Fee of Rs.10/- at reception
counter. Detail of payment of the financial year for which the certificate is
required.
V. Lumpsum Payment
The following documents are to be enclosed along with the application
addressed to Accounts Officer, CHB on the plain paper:
i. Detail of Payment
ii. Attested copy of GPA, in case
applicant is GPA holders
iii. Affidavit on stamp paper of
Rs.3/- duly attested by Ex. Magistrate from GPA holders
iv. Processing Fee Rs. 20/- for all
categories of houses (in case of running schemes only).
v. Copy of Physical Possession, if
any.
VI. Non Due Certificate
The following documents are to be enclosed along with the application
addressed to Accounts Officer, CHB on the plain paper:
i. Detail of Payment
ii. Attested copy of GPA, in case
applicant is GPA holders
iii. Affidavit from GPA holders
iv. Processing Fee Rs. 20/- for all
categories of houses (in case of running schemes only).
v. Copy of Physical Possession, if
any.
VII. DUPLICATE COPY OF ALLOTMENT LETTER
To be issued only to the original allottee. However, in case of GPA holder,
it can be allowed on confirmation by original allottee personally or consent in
writing.
The following documents are to be enclosed along with the application
addressed to Accounts Officer, CHB on the plain paper:
i. Affidavit from the applicant
ii. Indemnity Bond from the applicant
iii. Copy of DDR registered with the
Police Station
iv. Non tracing report there of.
v. One Photo & 3 specimen Signature
of applicant duly attested by Executive Magistrate /Gazetted Officer.
vi. NDC/Detail of payment.
vii. Attested copy of GPA if
applicant is GPA holder.
viii. Processing Fee 25/-
Publication Charges of Rs. 1860/- to be deposited at the Reception Counter.
Above important documents, should be preserved carefully by the allottees.
Duplicate copies can be issued in exceptional cases.
VIII. REFUND OF EARNEST MONEY & OTHER DEPOSITS MADE
An applicant can surrender, prior to or after the allotment of D.U., to seek
refund of the deposits as per terms and conditions of the Scheme/Allotment
letter.
Acknowledgement in original to be submitted with application to Account
Officer.
IX. ADDITION OF NAME OF SPOUSE
is allowed subject to the following conditions:-
No deed of conveyance has been executed. (Addition will only be in respect of
rights/tenancy rights in the D.U.).
All outstanding dues upto the date of addition are paid.
The spouse of the allot tee fulfills the eligibility
conditions regarding not owning any residential property in U.T. of Chandigarh,
Mohali, and Panchkula and also anywhere in India at concessional rates, i.e. at
fixed/reserved price, as specified under Regulation 6 of Chandigarh Housing
Board (Allotment, Management and Sale of Tenements) Regulations,1979, as amended
from time to time. However, the spouse of the allot tee need not be a resident
of U.T. of Chandigarh for three years on the date of transfer.
The D.U. is free from any litigation.
Both the allot tee and his/her spouse shall not be eligible for the allotment
of a D.U. in future, after the transfer is allowed.
The following documents are to be enclosed along with the application
mentioning the reason of the transfer on the plain paper: -
i. Processing Fee
(HIG-1000/-,MIG-500/-,LIG-250/-,EWS-100/-).
ii. Affidavit from the transferor
iii. Affidavit from the transferee
iv. Proof of relationship.
v. One photograph and three specimen
signatures of both the parties.
vi. Copy of Allotment Letter,
Transfer Letter and Physical Possession, if any
v. NDC/ Detail of payment
X. TRANSFER OF DWELLING UNIT (OTHER THAN D.Q. HOUSES) IN BLOOD RELATION
is allowed as per Regulation 16 of CHB (Allotment, Management and Sale of
Tenements) Regulations 1979 subject to following conditions:-
a. Period of 5 years from the date of
physical possession is over.
b. No deed of conveyance has been
executed.
c. All outstanding dues upto the date
of transfer are paid.
d. The transferee fulfills the
eligibility condition regarding not owning any residential property in U.T. of
Chandigarh, Mohali and Panchkula and also anywhere in India at concessional
rates, i.e. at fixed/reserved price.
e. The transferee is a major.
f. The D.U. is free from any
litigation
g. Both the allot tee and his/her
spouse shall not be eligible for the allotment of a D.U. in future, after the
transfer is allowed.
The following documents are to be enclosed along with the application on
prescribed form available at Reception Counter at the cost of Rs.20/- addressed
to the Accounts Officer, CHB mentioning the reason of the transfer. : -
i. Processing Fee (HIG-1000/-, MIG-500/-, LIG-250/-, EWS-100/-).
ii. Affidavit from the transferor
iii. Affidavit from the transferee
iv. One photograph and three specimen signatures of both the parties (self
attested). Transfer Fee @ 2-1/2% of the total cost of the D.U. to be deposited
at the reception counter when informed in writing.
v. Proof at Relationship (Self attested)
vi. NDC/Detail of payment (Transfer letter if any) Self attested
vii. NDC/NOC form mortgagee if DU is mortgaged.
After the acceptance of request, the applicant shall execute an agreement and
Indemnity Bond, as prescribed, with the Board.
XI. TRANSFER OF D.U. IN CASE OF DEATH OF REGISTERED APPLICANT/ ALLOTTEE/ SUB
LESSEE WHERE NO WILL HAS BEEN EXECUTED BY THE DECEASED ALLOTTEE.
is allowed as per Regulation 16 subject to the following conditions:-
a. No deed of conveyance has been executed
b. All outstanding dues upto the dates of transfer are paid.
c. The transferee is a major i.e. above the age of 18 years, or a minor under
guardianship.
d. The D.U. is free from any litigation.
Following documents are to be enclosed alongwith the Application prescribed
form available at Reception Counter: -
i. Affidavit from the claimant (as per specimen).
ii. Affidavits from the remaining legal heirs of right relinquish. (as per
specimen)
iii. One photograph and three specimen signatures of all legal heirs duly
attested by G/Officer or Ist class Magistrate Death Certificate of the deceased
in original.
iv. Death Certificate of the mother of the deceased/Affidavits form Govt.
Employee & form relation in case mother died before 1969.
v. Processing fee (HIG-1000/-,MIG-500/-,LIG-250/-,EWS-100/-)
vi. Death certificate of deceased allottee.
vii. Indemnity Bond claimant
viii. Agreement

XIII TRANSFER OF D.U. ON THE BASIS OF PROBATE WILL
is allowed as per Regulation 16 subject to the following conditions:-

b. All outstanding dues upto the dates of transfer are paid.
c. The transferee is a major i.e. above the age of 18 years, or a minor under
guardianship..
d. The D.U. is free from any litigation.

ii. Certified copy of the probate WILL
iii. One photograph and three specimen signatures of the applicant.
iv. Death Certificate of the deceased in original.

viii. NOC / Detail of Payment
After the acceptance of request, the applicant shall execute an agreement and
Indemnity Bond, as prescribed, with the Board.
Transfer on the basis as Required/Un-Register Will
TIME TO BE TAKEN: THREE WEEKS
IX (A) TRANSFER OF D.U. ON THE BASIS OF GPA/SUB GPA AND AGREEMENT TO SELL.
is allowed as per regulation 16 on submitting the prescribed application form
costing Rs. 10/- alongwith the prescribed documents and processing fee subject
to the following conditions:-
a. Period of 5 years from the date of physical possession is over.
b. No deed of conveyance has been executed.
c. All outstanding dues upto the date of transfer are paid.
d. The transferee fulfills the eligibility condition regarding not owning any
residential property in U.T. of Chandigarh, Mohali and Panchkula and also
anywhere in India at concessional rates, i.e. at fixed/reserved price.
e. The transferee is a major.
f. The D.U. is free from any litigation.
g. Both the allot tee and his/her spouse shall not be eligible for the
allotment of a D.U. in future, after the transfer is allowed.
h. Transfer fee @ 10% of the revised consideration of dwelling unit on the
date of such transfer, to be intimated by the CHB.
i. 5% additional transfer fee i.e. 5% of the revised consideration of D.U. on
the date of transfer in case Ist Sale transfer have been taken placed allotment
/ physical possession.
DOCUMENTS REQUIRED
i. Application on prescribed form available at the Reception Counter.
ii. Copy of GPA (Management and Sale)
iii. Agreement to Sell.

xii. Indemnity Bond by applicant is Ist / any sale agreement is missing on Rs.
5/- Stamp Paper
xiii. Affidavit from Joint Holder of GPA/SPA/ Agreement to Sell relinquishing
his / her rights.
xiv. Affidavit from Legal Heir claiming Transfer/ Mutation on the death of
GPA/SPA/Agreement to Sell.
The following documents will be submitted when demanded in writing: -
i. Indemnity Bond (require no attestation)
ii. Affidavit of surety alongwith documentary proof.
iii. Transfer Fee.
Note: The original documents will be produced at the time of interview.
THE DOCUMENTS
After the documents are found to be in order the applicant is informed to
deposit the transfer fee and furnish the prescribed indemnity bond, affidavits
of the surety. He/she is to appear with the surety, before the Secretary, on the
specified date and time for producing the original allotment letter and other
documents alongwith the original title deed(s) in respect of property(ies)
belonging to the sureties.
A public notice in respect t of approved cases would be published in two
newspapers to invite objections, if any, to the proposed transfer within 15 days
of the publication. If no objection is received, the transfer is carried out and
intimated to the applicant(s) within a week of the expiry of the notice period.
No transfer of rights/interest in the D.Us allotted out of Discretionary
Quota/is permissible under Regulation 16.
(B) TRANSFER OF D.U. ON THE MUTUAL REQUEST OF THE ALLOTTEE/HIRER AND THE
PROPOSED TRANSFEREE.
is allowed as per regulation 16 on submitting the prescribed application form
costing Rs. 10/- alongwith the prescribed documents and processing fee subject
to the following conditions:-
a. Period of 5 years from the date of physical possession is over.
b. No deed of conveyance has been executed
c. All outstanding dues upto the date of transfer are paid.
d. The transferee fulfills the eligibility condition regarding not owning any
residential property in U.T. of Chandigarh, Mohali and Panchkula and also
anywhere in India at concessional rates.
e. The transferee is a major
f. The D.U. is free from any litigation.
g. Both the transferor and transferee shall not be eligible for the allotment
of a D.U. in future.
h. Transfer fee @ 10% of the revised consideration of dwelling unit on the
date of such transfer, to be intimated by the CHB

v. Self attested Photo and specimen signature.
TIME TO BE TAKEN FOR PROCESSING: TWO WEEKS OF DOCUMENTS.
After the documents are found to be in order the applicants are informed to
deposit the transfer fee and furnish the prescribed Indemnity Bonds and further
to appear before the Secretary on the specified date and time for producing the
original allotment letter and other relevant documents.
TIME TO BE TAKEN: TWO WEEKS FROM THE DATE OF INTERVIEW WITH THE
SECRETARY.
X. NO OBJECTION /CLEARANCE CERTIFICATE FOR CONVERSION OF LAND UNDER THE D.U.
FROM LEASE-HOLD TO FREE-HOLD.
is issued on submission of prescribed application form and affidavit as per
checklist enclosed with the form subject to the following conditions:-
a. NDC stands issued
b. Uptodate ground rent is paid
c. In case applicant has raised loan from any financial institution/employer,
he/she should attach with the application form an NOC from such lending
institution/employer.
d. Affidavit required that No litigation is pending with regard to the title
of the dwelling unit or with the POA holder in any court of law.
e. Affidavit required that the DU is free from any violation/unauthorized
constructions or misuse.
XI. TRANSFER ON THE BASIS OF SALE DEED.
Following documents are to be enclosed alongwith the Application addressed to
the Secretary, CHB on plain paper:-
a. Copy of Sale Deed.
b. Indemnity Bond
c. Original Receipt of Processing Fee.
XII. PROCEDURE FOR CONVERSION OF LAND UNDER THE D.U. FROM LEASE-HOLD LAND
TENURE TO FREE -HOLD LAND TENURE.
Conversions is made by Estate Officer (Secretary, CHB) under "The Chandigarh
Conversion of Residential Lease-hold Land Tenure into Free-hold Land Tenure
Rules,1996" after the issuance of "No Objection/Clearance Certificate by CHB, on
payment of prescribed fee.
Brochure containing guidelines for conversion and the prescribed application
form is available at the Reception Counter of CHB on payment of Rs.25/- and at
Website of the Board.
DOCUMENT REQUIRED
i. Application on prescribed form available at the Reception Counter
ii. Three photographs of the applicant duly attested by G.O.
iii. Affidavit as per specimen in the Application Form attested by EM.
iv. Copy of Allotment Letter / Transfer letter if any
v. Copy of No Due Certificate issued by the Board / Detail of Payment of G.R.
vi. Copy of Physical Possession/ Proof of Possession
vii. No Objection Certificate from mortgagee, if any
viii. Conversion Fee in the form of DD favoring Estate Officer, U.T.
Chandigarh, as per chart available at the Reception Counter.
TIME TO BE TAKEN: THREE WEEKS
XIII PROCEDURE FOR EXECUTION OF LEASE DEED BETWEEN ALLOTTEE/HIRER AND CHB.
Lease Deed can be executed with the allot tee/hirer who has obtained "No Dues
Certificate" after payment of all the dues, in the prescribed performa approved
by the Chandigarh Administration. The allot tee/hirer will have to deposit stamp
duty of requisite value through Treasury Challan available in the Central
Treasury, U.T. Chandigarh.

XIV. EXECUTION OF CONVEYANCE DEED.
The following documents are to be enclosed along with the application on the
plain paper: -
i. Processing Fee as per intimation by Letter.
ii. Stamp duty of requisite value through treasury challan available in the
Central Treasury, U.T. Chandigarh as mentioned in letter.
iii. Three passport size photographs duly attested
iv. Copy of Challan to be submitted.
Note: conveyance Deed will be executed only in case of freehold properties.
XV. ADDITIONS/ALTERATIONS:
1. Prior permission is necessary before making any additions/alterations in
the dwelling units.
2. Some need based changes have been allowed.
3. No encroachment on Govt./common Land and no construction of extra floor is
permissible.
4. Unauthorized construction invites
a. Cancellation of allotment and eviction.
b. Demolition of unauthorized construction at the cost of the allottee.
XVI CANCELLATION OF ALLOTMENT:
is attracted on:
i. Breach of terms of allotment including non-payment of dues.
ii. Furnishing of false information/suppression of facts.
iii. Misuse of dwelling unit.
iv. Unauthorized Construction.
XVII. APPEAL:
i) Under Section 72A of Haryana Housing Board Act, 1971, as extended to U.T.
Chandigarh, lies within 30 days:-
a. Against the cancellation order passed by the CEO, to the Chairman.
b. Against the orders of Chairman, to the Board.
Under Section 54 appeal against the order of eviction passed by the Competent
Authority who is the Secretary of the Board, under Section 51 lies before the
District Judge, Chandigarh within 30 days.
XVIII REVISION
Under section 72B against any order passed by the Board, Chairman and Chief
Executive Officer lies to the Administrator, U.T., Chandigarh.
C) FOR PROSPECTIVE ALLOTTEES
Applications for registration and allotment of dwelling units are invited
under various Housing Schemes through wide publicity in leading newspapers. The
information with regard to the scope of the scheme, specifications, tentative
cost and terms and conditions of the allotment is available in the brochure of
the scheme available with the application form. The applicants are required to
adhere to the terms and conditions as given in the brochure. The eligibility is
determined by the Property Allotment Committee of the Board on the basis of the
information supplied by the applicants and the ineligible applicants are
informed accordingly. They can file an appeal under Regulation 23 before the
Board within 30 days of the decision of the Committee.
The registration of floor is made through public draw of lots and waiting
list is drawn equal to 20% of the number of dwelling units which remains valid
for a period of one year from the date of draw of lots. The registered
applicants are issued Acceptance-cum-demand letter calling upon them to make
payments as per the schedule given thereunder. Non-payment/delay beyond 3 months
invites cancellation of registration.
D) COMMERCIAL PROPERTIES ALLOTTED BY THE CHB
Commercial properties allotted by CHB through Public Auction/allotment are

Procedure for the issue of certificates regarding No Objection for obtaining

Dues and also for issue of copies of allotment letter/possession slip/physical
possession form and for transfer in death cases is the same as in the case of
dwelling units and the same is available at the Reception Counter and CHB
Website.
Any breach of terms of auction/allotment, including non-payment of
installments, misuse of premises, unauthorized construction, addition and
alteration in the buildings, invites cancellation and resumption of the premises
and forfeiture of whole or part of the amount deposited.
